What must be in my final pay? Leave and severance explained
Unused annual leave must be paid out. Severance of one week per completed year applies only to retrenchments.
On termination the employer must pay all wages owed, plus unused annual leave for the current cycle and any leave not yet taken from the previous cycle (BCEA s40).
If the employer ends the contract and does not want you to work notice, they must pay notice in lieu.
Severance pay of at least one week per completed year of service is due only when you are dismissed for operational requirements (retrenchment). It is not due on resignation or dismissal for misconduct.
