What notice period does the BCEA require?
One week in the first 6 months, two weeks up to a year, and four weeks after a year of service.
Under BCEA s37 the minimum notice is one week if employed 6 months or less, two weeks if more than 6 months but not more than a year, and four weeks after a year. Farm and domestic workers employed more than 6 months get four weeks.
Notice must be in writing. An employer may pay out the notice period instead of having the employee work it.
A contract can give longer notice, but never shorter than the BCEA minimum.
